My Pocket Plus - Terms and Conditions

Welcome to My Pocket Plus! These Terms and Conditions ("Terms") govern your use of the My Pocket Plus mobile application (the "App"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the App.

Acceptance of Terms

By using the My Pocket Plus app, you acknowledge that you have read, understood, and agree to be bound by these Terms. These Terms constitute a legally binding agreement between you and My Pocket Plus.

Changes to Terms

My Pocket Plus reserves the right to modify or update these Terms at any time. We will notify you of any changes by posting the new Terms within the App or on our website. Your continued use of the App after any such changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically for updates.

User Content

The App allows you to submit, upload, publish, or otherwise make available content, including but not limited to card details, member information, images, and other related data (collectively, “User Content”). You are solely responsible for your User Content and the consequences of posting or publishing it.

You retain all rights in and to your User Content. However, by submitting User Content to My Pocket Plus, you grant My Pocket Plus a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, copy, modify, and display your User Content in connection with the operation of the App and its services. You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to publish User Content you submit.

User Conduct

You agree not to use the App to: (a) upload, post, or otherwise transmit any User Content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libellous, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable; (b) harm minors in any way; (c) impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity; (d) upload, post, or otherwise transmit any User Content that you do not have a right to transmit under any law or under contractual or fiduciary relationships; (e) upload, post, or otherwise transmit any User Content that infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party; (f) upload, post, or otherwise transmit any unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or any other form of solicitation; (g) upload, post, or otherwise transmit any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment; (h) interfere with or disrupt the App or servers or networks connected to the App, or disobey any requirements, procedures, policies, or regulations of networks connected to the App; (i) intentionally or unintentionally violate any applicable local, state, national, or international law.

Intellectual Property

The My Pocket Plus app and its original content, features, and functionality are and will remain the exclusive property of My Pocket Plus and its licensors. The App is protected by copyright, trademark, and other laws of both Canada and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of My Pocket Plus.

Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the App will immediately cease.

Disclaimer of Warranty

The My Pocket Plus app is provided on an “AS IS” and “AS AVAILABLE” basis. Use of the App is at your own risk. To the maximum extent permitted by applicable law, the App is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. My Pocket Plus does not warrant that the App will function uninterrupted, secure, or available at any particular time or location; that any errors or defects will be corrected; or that the App is free of viruses or other harmful components.

Limitation of Liability

In no event shall My Pocket Plus, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the App; (ii) any conduct or content of any third party on the App; (iii) any content obtained from the App; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Governing Law

These Terms shall be governed and construed in accordance with the laws of Canada, without regard to its conflict of law provisions.
